<p>On May 23, 1988 at 8 a.m. — eight days after <a href="http://steveprestegard.com/2013/05/15/a-little-late-now-in-more-ways-than-one-but/">my graduation from the University of Wisconsin</a> — I started work at the Grant County Herald Independent in Lancaster, the first day in a quarter-century of <a href="http://steveprestegard.com/adventures-in-rural-ink/">print and/or rural media adventures</a>.</p>
<p>Some thoughts about that can be read in <a href="http://www.swnews4u.com/section/95/article/13306/">this fine publication</a>.</p>
<p>I am so overscheduled today that I have little to  say on this subject &#8230; other than that I have to get to work, and that no public celebration of this anniversary is planned.</p>

<p>As you may be able to discern from the headline, <a href="http://freedominthe50states.org/overall/wisconsin">Wisconsin ranks 38th</a>. More specifically, out of the more than 200 factors the survey measures, Wisconsin ranks:<br />
1st in <a href="http://freedominthe50states.org/cable-and-telecom/wisconsin">cable and telecom freedom</a>, <a href="http://freedominthe50states.org/rent-control/wisconsin">rent control freedom</a> (that is, lack of rent control), &#8220;<a href="http://freedominthe50states.org/kegs/wisconsin">keg freedom</a>&#8221; (regulation or bans on kegs), &#8220;<a href="http://freedominthe50states.org/happy-hour/wisconsin">happy hour freedom</a>&#8221; (in other words, a bar can have happy hour) and <a href="http://freedominthe50states.org/helmets/wisconsin">helmet freedom</a> (whether motorcycle or bicycle helmets are required).<br />
<a href="http://freedominthe50states.org/misc.-regulations/wisconsin">2nd</a> in &#8220;miscellaneous regulatory freedom&#8221; (&#8220;regulations governing hospitals, auto insurance, and homeowners’ insurance&#8221;).<br />
<a href="http://freedominthe50states.org/alcohol/wisconsin">4th</a> in &#8220;alcohol freedom.&#8221;<br />
<a href="http://freedominthe50states.org/alcohol-taxes/wisconsin">6th</a> in &#8220;alcohol tax freedom.&#8221;<br />
<a href="http://freedominthe50states.org/asset-forfeiture/wisconsin">7th</a> in &#8220;asset forfeiture freedom.&#8221;<br />
<a href="http://freedominthe50states.org/family-friendliness/wisconsin">8th</a> in &#8220;family-friendly freedom.&#8221;<br />
15th in <a href="http://freedominthe50states.org/regulatory/wisconsin">regulatory freedom</a>, <a href="http://freedominthe50states.org/marriage/wisconsin">marriage freedom</a> and <a href="http://freedominthe50states.org/fireworks/wisconsin">fireworks freedom</a>.<br />

19th in <a href="http://freedominthe50states.org/health-insurance/wisconsin">health insurance freedom</a> and &#8220;<a href="http://freedominthe50states.org/seat-belts/wisconsin">seat belt freedom</a>&#8221; (that is, a measurement of the state&#8217;s seat belt laws).<br />
21st in <a href="http://freedominthe50states.org/drug-enforcement/wisconsin">drug enforcement freedom</a>.<br />
<a href="http://freedominthe50states.org/liability-system/wisconsin">22nd</a> in &#8220;freedom from tort abuse.&#8221;<br />
23rd in <a href="http://freedominthe50states.org/labor-market/wisconsin">labor market freedom</a>, &#8220;<a href="http://freedominthe50states.org/right-to-work/wisconsin">right-to-work freedom</a>&#8221; and <a href="http://freedominthe50states.org/eminent-domain/wisconsin">eminent-domain freedom</a>.<br />
27th in <a href="http://freedominthe50states.org/occupational-licensing/wisconsin">occupational licensing freedom</a>, <a href="http://freedominthe50states.org/marijuana-and-salvia/wisconsin">marijuana and salvia</a> (that is, medical marijuana) freedom and <a href="http://freedominthe50states.org/civil-liberties/wisconsin">civil liberties freedom</a>.<br />
29th in &#8220;<a href="http://freedominthe50states.org/nanny-laws/wisconsin">freedom from nanny laws</a>&#8221; and &#8220;<a href="http://freedominthe50states.org/food/wisconsin">food freedom</a>&#8221; (bans on trans fats and raw milk).<br />
<a href="http://freedominthe50states.org/education/wisconsin">31st</a> in education freedom.<br />
32nd in &#8220;<a href="http://freedominthe50states.org/find-a-job/wisconsin">finding a job freedom</a>&#8221; and &#8220;<a href="http://freedominthe50states.org/gun-control/wisconsin">gun control freedom</a>.&#8221;<br />
<a href="http://freedominthe50states.org/property-rights/wisconsin">34th</a> in property rights.<br />
37th in <a href="http://freedominthe50states.org/personal/wisconsin">personal freedom</a> and <a href="http://freedominthe50states.org/victimless-crimes/wisconsin">victimless crime freedom</a>.<br />
38th in <a href="http://freedominthe50states.org/economic/wisconsin">economic freedom</a> and <a href="http://freedominthe50states.org/travel/wisconsin">travel freedom</a> (&#8220;seat belt laws, helmet laws, mandatory insurance coverage, and cell phone usage laws&#8221;).<br />
<span style="font-size:13px;">43rd</span><span style="font-size:13px;"> in </span><a style="font-size:13px;" href="http://freedominthe50states.org/fiscal/wisconsin">fiscal freedom</a><span style="font-size:13px;"> and (state and local) </span><a style="font-size:13px;" href="http://freedominthe50states.org/tax-burden/wisconsin">tax burden</a><span style="font-size:13px;">.<br />
<a href="http://freedominthe50states.org/tobacco/wisconsin">45th</a> in &#8220;tobacco freedom.&#8221;<br />
<a href="http://freedominthe50states.org/bachelor-party/wisconsin">48th</a> in &#8220;bachelor party freedom&#8221; (&#8220;a variety of laws including those on alcohol, marijuana, prostitution, and fireworks&#8221;).<br />
<a href="http://freedominthe50states.org/campaign-finance/wisconsin">49th</a> in campaign financing freedom (freedom here means the lack of taxpayer financing of political campaigns).<br />
<a href="http://freedominthe50states.org/gambling/wisconsin">50th</a> in &#8220;gambling freedom.&#8221;</span></p>
<p>This year&#8217;s study includes data going back to 2001. That&#8217;s useful because between 2001 and now, this state has had nearly every conceivable combination of party control of the Executive Residence and the Legislature. And since 2001, Wisconsin has ranked no better than 36th, and as low as 42nd. This suggests that the state Democratic and Republican parties have fully embraced the concept of America&#8217;s Nannyland, possibly in different areas depending on party.</p>
<p>About Wisconsin, the authors say:</p>
<blockquote><p>Wisconsin has slipped slightly since the last edition of the index and is now just outside the bottom 10. However, this is one state that may already be improving due to legislative changes since the data cutoff for this study. For example, Governor Scott Walker and the state legislature have agreed to budget cuts in education and other areas, while passing Act 10—which aims to limit the bargaining power of public employee unions (though it is unclear whether this law will survive legal challenges). &#8230; Therefore, Wisconsin’s rank is likely to improve in the next edition of <em>Freedom in the 50 States</em>.</p></blockquote>
<p>You will be shocked — shocked! — to find how Wisconsin ranks generally in economic freedom:</p>
<blockquote><p>Wisconsin ranks near the bottom in economic freedom, due primarily to its poor fiscal policy. Wisconsin’s overall tax burden is very high, as are individual income and property taxes. State spending and debt are roughly average. However, its benefit payments are quite high, as is its level of transportation spending. Moreover, Wisconsin government employment is quite large relative to the private workforce.</p></blockquote>
<p>The study could also be described as the extent to which state law treats adults like adults:</p>
<blockquote><p>Wisconsin fares a lot better in regulatory policy, ranking 15th. It is slightly worse than average in terms of land-use regulation but has passed some eminent domain reforms. Wisconsin’s labor market freedom, occupational freedom, health insurance freedom, and liability system are mediocre. It is not (yet) a right-to-work state, but has avoided mandating a minimum wage above the federal average or requiring employers to buy short-term disability insurance. Wisconsin does not have community rating (though there are small-group rate bands) or rate reviews. Wisconsin has also deregulated cable and telecom. It does quite well in terms of insurance rate filing requirements. However, it is almost a standard deviation worse than the mean on occupational licensing.</p>
<p>Wisconsin performs below average in a number of personal freedom categories. The state has high victimless crimes arrest rates, though its drug enforcement rate is below average. It has the worst gaming laws in the country (social gambling is not allowed) and almost the strictest campaign finance laws. The state also performs below average on gun freedom and travel freedom. Home schools are regulated with some onerous notification requirements. Wisconsin has some of the best alcohol laws in the country, with taxes fairly low across the board. However, its cigarette taxes are very high and smoking bans are extensive.</p></blockquote>
<p>The authors have some policy recommendations for this state, most of which have zero chance of happening:</p>
<blockquote>
<ul>
<li><span style="font-size:13px;">Reduce the income tax burden while continuing to cut back spending through cuts in government employment and public employee benefits.</span></li>
<li><span style="font-size:13px;">Pass a right-to-work law, whenever political conditions so allow.</span></li>
<li><span style="font-size:13px;">Reform tobacco and marijuana regulations, using the state’s alcohol-friendly beer, wine, and spirits regulations as a model.</span></li>
</ul>
</blockquote>
<p>Why and how is this important?</p>
<blockquote><p>While previously the authors developed a subjective weighting system in which they sought to determine how significantly policies limited the freedom of how many people, in this edition they have use a victim-cost method, assigning a dollar value to each variable that restricts freedom <a href="http://pileusblog.wordpress.com/2013/03/12/freedom-in-the-50-states-teaser-3-weighting-the-variables/">measuring the cost of restricting freedom for potential victims</a>. The authors&#8217; cost calculations are designed to measure the value of the states&#8217; freedom for the average resident. Since individuals measure the cost of policies differently, readers can put their own price on each freedom variable on the website to find the states that best match their subjective policy preference. &#8230;</p>
<p>Freedom is not the only determinant of personal satisfaction and fulfillment, but as our analysis of migration patterns shows, it makes a tangible difference for people&#8217;s decisions about where to live.</p></blockquote>
<p>It is logically inconsistent to oppose government intrusion into your wallet, but not government intrusion in your bedroom. And vice versa. But it&#8217;s not surprising that Wisconsin ranks low in freedom across the board, because (a reader jogged my memory about this) <a href="http://steveprestegard.com/2011/08/23/the-cheesehead-presidential-candidate-or-not/">the culture of those who settled Wisconsin</a> didn&#8217;t consider freedom a priority. Historial Daniel Elazar divided the states into three dominant political cultures:</p>
<blockquote><p>• <em>Individualistic:</em> This culture “emphasizes the centrality of private concerns,” placing “a premium on limiting community intervention.” The individualistic culture originated in such mid-Atlantic, non Puritan states as Pennsylvania, New Jersey, Delaware, and Maryland; it spread west to become dominant in Ohio, Indiana, Illinois, and Missouri; and later it spread to such states as Nevada, Wyoming and Alaska.</p>
<p>• <em>Traditionalistic:</em> This is a political culture that “accepts government as an actor with a positive role in the community,” but seeks to “limit that role to securing the continued maintenance of the existing social order.” Not surprisingly, the traditionalistic strain of American politics is a major factor in all of the border and southern states, extending west to Oklahoma, Texas, New Mexico, and Arizona.</p>
<p>• <em>Moralistic: </em>The “moralistic” culture considers government “a positive instrument with a responsibility to promote the general welfare.” This culture is predominant in 17 states that stretch from New England through the upper Midwest to the Pacific coast — what several observers of American history and politics have called “Greater New England.” Even more significantly, this moralistic approach is virtually the only political culture found in nine states: Maine, Vermont, Michigan, Minnesota, North Dakota, Colorado, Utah, Oregon, and, not surprisingly, Wisconsin.</p>
<p>The states in this last group, Elazar notes, were “settled initially by the Puritans of New England and their Yankee descendants … [who] came to these shores intending to establish the best possible earthly version of the holy commonwealth. Their religious outlook was imbued with a high level of political concern.” Most significantly for states like Wisconsin and Minnesota, “they were joined by Scandinavians and other northern Europeans who, stemming from a related tradition (particularly in its religious orientation), reinforced the basic patterns of Yankee political culture, sealing them into the political systems of those states.”</p></blockquote>
<p>&#8220;Moralistic&#8221; is a culture that apparently, and unfortunately, appeals to both Democrats and Republicans in Wisconsin. And &#8220;moralistic,&#8221; as defined by Elazar, is the opposite of &#8220;free.&#8221;</p>

Of course, if you had to defend Obamascandalgate and Wisconsin Democrats, you might be rude and long-winded while insulting everyone who doesn&#8217;t share your viewpoints or lofty educational level too.</p>
<p>(Perhaps I&#8217;ll have to repeat my favorite lawyer joke: What do you call 100 lawyers thrown out of an airplane without parachutes? Skeet.)</p>
<p>Before all that, I will be announcing this afternoon&#8217;s WIAA Division 4 softball regional final between Belmont and Highland at <a href="http://theespndoubleteam.com/">theespndoubleteam.com</a>. Today is <a href="http://steveprestegard.com/adventures-in-rural-ink/">the 25th anniversary of my employment in Southwest Wisconsin</a>, so perhaps it&#8217;s appropriate that I&#8217;m doing a game today, since this year is <a href="http://steveprestegard.com/adventures-in-radio/">the 25th anniversary of my broadcasting sports</a>.</p>

<p>When the tornado warning was issued outdoor sirens sounded, local TV and radio stations ceased regular programming and started continuous coverage. NOAA weather radios alarmed. Smartphone apps activated. Two TV stations’ helicopters were showing the tornado – live – approaching Moore.</p>

There was the spectacle of advocates of an ever-larger regulatory government expressing shock about such government’s large capacity for misbehavior. And, entertainingly, the answer to the question “Will Barack Obama’s scandals derail his second-term agenda?” was a question: What agenda?</p>
<p>The scandals are interlocking and overlapping in ways that drain his authority. Everything he advocates requires Americans to lavish on government something that his administration, and big government generally, undermines: trust.</p></blockquote>

<blockquote><p>Liberalism’s agenda has been constant since long before liberals, having given their name a bad name, stopped calling themselves liberals and resumed calling themselves progressives, which they will call themselves until they finish giving that name a bad name. The agenda always is: Concentrate more power in Washington, more Washington power in the executive branch and more executive power in agencies run by experts. Then trust the experts to be disinterested and prudent with their myriad intrusions into, and minute regulations of, Americans’ lives. Obama’s presidency may yet be, on balance, a net plus for the public good if it shatters Americans’ trust in the regulatory state’s motives.</p></blockquote>
<p>(By the way: Replace &#8220;Washington&#8221; in the previous paragraph with &#8220;Madison,&#8221; and you have perfectly described Wisconsin.)</p>
<blockquote><p>One tactic was to misrepresent the Benghazi attack, lest it undermine his narrative about taming terrorism. Does <em>anyone</em> think the administration’s purpose in manufacturing<a href="http://www.washingtonpost.com/blogs/post-politics/wp/2013/05/15/benghazi-emails-released-by-white-house/#emails">12 iterations of the talking points </a>was to make them more accurate?</p>
<p>Another tactic was using the “federal machinery to screw our political enemies.” The words are from a 1971 memo by the then-White House counsel, <a href="http://www.washingtonpost.com/wp-srv/onpolitics/watergate/johndean.html">John Dean</a>, whose spirit still resides where he worked before going to prison. Congress may contain some Democrats who owed their 2012 election to the IRS’s suppression of conservative political advocacy.</p>
<p>Obama’s supposed “trifecta” of scandals — <a href="http://www.washingtonpost.com/politics/obama-administration-releases-e-mails-detailing-agencies-debate-over-benghazi/2013/05/15/e177cc80-bda8-11e2-9b09-1638acc3942e_story.html">Benghazi</a>, <a href="http://www.washingtonpost.com/politics/obama-vows-to-hold-irs-officials-accountable/2013/05/16/c8fe72e4-be3e-11e2-97d4-a479289a31f9_story.html">the IRS </a>and the <a href="http://www.washingtonpost.com/world/national-security/under-sweeping-subpoenas-justice-department-obtained-ap-phone-records-in-leak-investigation/2013/05/13/11d1bb82-bc11-11e2-89c9-3be8095fe767_story.html">seizure of Associated Press phone records </a>— neglects some. A fourth scandal is <a href="http://www.washingtonpost.com/business/senate-panel-considers-bipartisan-slate-of-5-nominees-for-politically-fractured-labor-board/2013/05/16/88a20fbe-be00-11e2-b537-ab47f0325f7c_story.html">power being wielded by executive branch officials </a>(at the National Labor Relations Board and the Consumer Financial Protection Bureau) <a href="http://articles.washingtonpost.com/2012-10-10/opinions/35498394_1_recess-appointments-presidential-appointments-vacancies">illegally installed in office </a>by presidential recess appointments made when the Senate was not in recess.</p>
<p>A fifth might be from Health and Human Services Secretary Kathleen Sebelius, who<a href="http://www.washingtonpost.com/blogs/wonkblog/wp/2013/05/10/budget-request-denied-sebelius-turns-to-health-executives-to-finance-obamacare/">solicited funds from corporations</a> in industries that HHS regulates to replace some that Congress refused to appropriate. The money is to be spent by nonprofit ­— which does not mean nonpolitical — entities. The funds are to educate Americans about, which might mean (consider the administration’s Benghazi and IRS behaviors) propagandize in favor of, Obamacare and to enroll people in its provisions. The experienced (former governor, former education secretary, 10 years in the Senate) and temperate<a href="http://www.alexander.senate.gov/public/index.cfm?p=LamarAlexander"> Lamar Alexander (R-Tenn.)</a>compares this to <a href="http://www.washingtonpost.com/blogs/wonkblog/wp/2013/05/14/lamar-alexander-sebelius-fundraising-arguably-an-even-bigger-issue-than-iran-contra/">the Iran-contra scandal</a>, wherein the Reagan administration raised private funds to do what Congress had refused to do — finance the insurgency against Nicaragua’s government. &#8230;</p>
<p>Because Obama’s entire agenda involves enlarging government’s role in allocating wealth and opportunity, the agenda now depends on persuading Americans to trust him, not their lying eyes. In the fourth month of his second term, it is already too late for that.</p></blockquote>

				<content:encoded><![CDATA[<p>The Wall Street Journal&#8217;s <a href="http://blogs.wsj.com/peggynoonan/2013/05/17/stay-shocked/?mod=WSJBlog">Peggy Noonan</a> proves my Clinton-era observation that if you&#8217;re not cynical about politics, you&#8217;re not paying attention:</p>
<blockquote><p>It actually <i>is</i> shocking that the IRS appears to have become political and ideological in a way that is systemic. It <i>is</i> shocking that the president claimed he read about the targeting of conservatives just last Friday, in the newspapers, and today the New York Times reports the leadership of the Treasury Department was told the charges were being investigated a year ago.</p>
<p>And it has to be remembered that this is not your ordinary scandal. Your ordinary scandal is an embarrassment. Somebody did something bad and there’s an investigation or hearings. People are made to suffer for their missteps, if only in terms of notoriety and legal expense. Sometimes the innocent or mostly innocent are dragged in, too. But in the end it passes. Some new laws are passed or rules instituted. And we move on to the next scandal. In a government populated by humans there will never be a lack of them.</p>
<p>But the IRS scandal is different because it speaks of the political corruption of a major and crucial governmental agency to whose rules and regulations every American—everyone who has a job or a bank account, or who engages in a financial transaction—is subject. Most people will never have an interaction with the State Department or the Bureau of Labor Statistics, but the IRS deals with an intimate and sensitive part of your life, your personal finances. It is the revenue-collecting arm of the government. It is needed. It does necessary work. When that work is done well it is rarely noted and almost never celebrated. When it’s done badly it’s a terrible thing, because it means a citizen was treated badly or abused. But as an agency it couldn’t be more important to the national mood, the national atmosphere.</p>
<p>If we allow it to become politically corrupt that scandal will not pass, it will be with us every day&#8230;.</p>
<p>The targeting of conservative groups and individuals by the IRS was a political operation that had political effects. We know this because only people with certain assumed political views were targeted and abused. No liberal groups were. According to today’s Washington Post, the Barack H. Obama Foundation, run by the president’s half-brother and named after their father, sailed through to tax-exempt status in a matter of weeks.</p>
<p>When a problem is political it’s best to have politically independent people investigate it.</p>
<p>Again, if what happened at the IRS is not stopped now, it will never stop. The next White House will come in and they’ll know they can do it too. And if they’re unlucky enough to be caught, they’ll have a have a few uncomfortable moments in Congress, and a few people who were going to retire in the summer will retire in the spring. And it will all go on.</p>
<p>We are at a point now where you can make a list of things that, all combined and allowed to continue, can kill America. This is one of them. Widespread belief that the revenue-collecting arm of the US government is hopelessly corrupt is one of them.</p></blockquote>
